TERMS AND CONDITIONS

These terms and conditions apply solely between G.T. GETO GROUP LTD, a limited liability company registered under the laws of Cyprus, having its registered office at  106, Gladstonos , 3032, Limassol, Cyprus.  hereinafter “Decathlon ” or we," "us", or "our"),”, and any person who access, uses, or obtains any service or makes any purchase hereinafter “User”,  through the website www.decathlon.com.cy, hereinafter the “Website”, and collectively “the Parties”. The User declares that she/he is of full age or has parental permission and has the legal capacity to contract and is accordingly able to place an order through the Website. The Parties agree that their relationship will be governed solely by these terms and conditions.

Although Decathlon endeavors to ensure that the information on the Website is complete and accurate, the Website may contain errors or inaccuracies. Decathlon reserves the right to correct such errors or inaccuracies and, at any time, to change or update the information on the Website relating to the prices, availability and, description of the products offered. It is therefore agreed that the applicable terms and conditions are those in effect on the Website at the time the order is placed.

Decathlon has the authority to modify or discontinue the Service at its own discretion and without prior notice. We won't be held responsible if, for any reason, the Service or any portion of it becomes unavailable temporarily or permanently.

DEFINITIONS

 “Content” refers to the text, documents, information, data, articles, images, photographs, graphics, Marks, software, applications, video recordings, audio recordings, sounds, designs, features, and other materials that are available on the Service.

“Decathlon”, “we”, “us” or “our” refers to G.T. GETO GROUP LTD, a limited liability company registered under the laws of Cyprus, having its registered office at 106, Gladstonos , 3032, Limassol, Cyprus. Decathlon's affiliates include Decathlon France SA.

“Marks” refers to trademark, trade name, service mark, trade dress, logo, custom graphics, or icon.

“Service(s)” refers to the Website, Content, and other products and services (such as the ability to post comments, ask questions, etc.) provided by Decathlon.

“User” or “Users” or “you” or “your” refers to the individual(s) visiting or using the Website.

“Website” refers to the website located at www.decathlon.com.cy

CONDITIONS OF USE

To be able to use the Services, you warrant that:

• You are at least 18 years old.
• You possess the legal authority to create a binding legal obligation.
• You will use the Service in accordance with these Terms and Conditions.
• You will only use the Service in accordance with applicable laws.
• All information that you supply to the Service will be true, accurate, current, and complete.
• If you have a Decathlon account (e.g., a User account or a registered user account), you will safeguard your account information and will supervise and be fully responsible for any use of your account by you and anyone other than you.

 

RESTRICTED USES

You are permitted to utilize the Website solely for lawful activities and in adherence to these Terms and Conditions. Beyond the limitations specified in these Terms and Conditions you are not allowed to engage in the following actions concerning this Website or its Content:

• Violating or contravening any international, provincial, or any regulations, rules, laws, or local ordinances;
• Soliciting others to engage in unlawful acts;
• Exploiting, harming, or attempting to exploit or harm minors by exposing them to inappropriate Content, requesting personally identifiable information, or engaging in similar actions;

• Pursuing any obscene or immoral objectives;
• Infringing upon Decathlon's intellectual property rights or the intellectual property rights of others;
• Submitting false or deceptive information;
• Transmitting, or procuring the sending of, any advertising or promotional material, including any "junk mail," "chain letter," or "spam," or any other similar solicitation.

Furthermore, you consent not to:

• Utilize the Website in a manner that could disrupt the functionality or operation of the Service;
• Use any robot or other automated device to access the Website for any purpose, including monitoring or copying any material on the Website;
• Use any manual or automated process to monitor or copy any material on the Website or for any other unauthorized purpose without our prior written consent;

 

LICENSE

Provided you adhere to these Terms and Conditions, Decathlon grants you a restricted, non-transferable license to access and utilize the Service solely for personal purposes and not for commercial use. Decathlon retains all rights not explicitly granted herein.

You are prohibited from reproducing, distributing, modifying, creating derivative works of, publicly displaying, publicly performing, republishing, or transmitting any portion of the Service. You must not remove or alter any copyright, trademark, or other proprietary rights notices displayed on the Service.

Should you desire to utilize any part of the Service beyond what is specified in this section, please direct your inquiry to the contact information provided in the “Contact Us" section.

Violation of this section will result in the immediate termination of your right to use the Website.

 

TRADEMARKS 

The Marks showcased on the Service are either registered or unregistered Marks of Decathlon, its affiliates, or licensors. Without prior written consent from Decathlon, you are prohibited from utilizing such Marks. Any other names, logos, product and service names, designs, and slogans appearing on this Website are the trademarks of their respective owners and are governed by their respective trademark policies.

 

AVAILABILITY

The products and prices we offer are valid for as long as they are visible on the Website, other than for special offers. The User is urged to check the availability of the articles sold on the information page for each product.

If an item is ordered that is determined to be unavailable, Decathlon reserves the right to cancel the order, provided that it gives the User notice.

If one of the products ordered is unavailable, Decathlon will inform the User that the unavailable item cannot be shipped. The rest of the order will be processed and shipped to the User under his confirmation within the time stated in the email providing information about tracking the order.

 

ORDER

The material posted by Decathlon on the Website consists of offers to purchase relating to the products presented on the Website (the “Offer”).  Decathlon reserves the right to reject, correct, cancel or, terminate any Offer for any reason whatsoever, without notice, and/or to limit the quantity that may be purchased of any item presented in an Offer. The product order that you submit to Decathlon through the Website constitutes your order (the “Order”). It may be necessary, at any time, for Decathlon to verify personal information or information relating to credit cards or payment cards with your credit card issuer or our payment solution provider before accepting any Order. Once payment for an Order has been verified, you will receive an email confirming the transaction.

To place an Order, you must follow several steps:

• The User must create an account on the Website and identify themselves, to place the Order.
• The User places products in their basket
• The User chooses a delivery method.
• The User chooses a payment method.
• The User makes the payment.
• The User then receives an email from Decathlon recording the payment.

The order validation email constitutes Decathlon’s acceptance of the User’s order and accordingly forms the contract of sale between the Parties. Your diligence in reviewing and confirming the order details contributes to a seamless shopping experience.

By using the Service, you agree to furnish up-to-date, thorough, and precise billing and account details for all purchases you make. You also commit to promptly updating your account particulars, such as your email address, credit card number(s), and expiration date(s), to ensure Decathlon can process your transactions and reach out to you if necessary. 

 

PRICE AND PAYMENT METHODS

You agree to pay the price and all charges shown for the transaction. Unless otherwise indicated, local taxes, including VAT, are calculated based on the address where the product is made available for pickup. All amounts are in Euro (€).

Decathlon.com.cy contains a diverse range of products, and it is possible that, despite our best efforts, some of the products listed on Decathlon.com.cy may be incorrectly priced. We will normally verify prices as part of our dispatch procedures, so where a product's correct price is less than our stated price, we will charge you the lower amount. If a product’s correct price is higher than the price stated on the site, we will charge you with the lower price.

The prices of products shown on the website are understood to include VAT and exclude shipping charges, the price of certain packaging, or the price of other optional services selected by the User, which are charged separately. The User will be informed of those charges on the Order summary page before the final validation of the Order. We usually charge purchases to your credit card before the process of sending your order has begun. In case of an out-of-stock product, we operate the refund on your credit card or payment card.

The User may pay for purchases by credit card or by Visa or MasterCard payment card.

The Website’s payment provider Viva is a  Level 1 PCI-DSS compliant payments platform. Viva uses HTTPS & Point-to-point Encryption, use of certified Hardware Security Modules, strict key management controls, and near real-time threat detection.

The User is informed that the offers of products and services and the prices offered for purchase in Decathlon’s stores are not applicable to purchases on the decathlon.com.cy website and vice versa. Prices may vary according to the commercial policy of each Decathlon store.

 

DELIVERY

All our orders can be delivered to all the areas in Cyprus listed on the Website. 

The delivery times shown on the Website are counted from the date on which the payment is confirmed. The estimated delivery date will be confirmed in the order confirmation email.

 

OUR PRODUCT WARRANTY

At Decathlon, we stand behind the quality of our products. In the rare event of a manufacturing defect, rest assured! Our products are backed by a minimum guarantee of 2 years, and non-Decathlon items are guaranteed for 1 year unless otherwise specified.

Refund Process:

In case of a proven defect, we will refund both the initial cost of the item and the transportation expenses. The warranty specifically covers defects arising during normal use of the product.

Exclusions:

This warranty doesn't extend to problems caused by negligence, deterioration, or inappropriate use by the User. We want to emphasize that defects resulting from improper installation or mishandling of equipment, gear, accessories, or other products offered by Decathlon are not covered.

For all types of defects, please reach out to our User service either through the "Contact Us" link in the website footer. We are here to assist you.

 

ORDER CANCELLATION

If you wish to cancel your order, please initiate the process promptly. You can either chat with us or submit a request through the "Contact Us" link as soon as you place your order. We will make every effort to accommodate your request, provided that the order is still under preparation and hasn’t been handed over to the courier.

In the event that your order cannot be fulfilled within the scheduled time due to an item being out of stock, you will receive an email notification about the cancellation of the order. If only one item in your order is out of stock, we will contact you to discuss whether you would like to proceed with the remaining items or if you prefer to cancel the entire order.

 

PRODUCT RETURNS

We value your satisfaction and strive to make your online shopping experience on the Website enjoyable. If, for any reason, you are not entirely satisfied with your purchase and wish to return the product, you have two convenient options:

• In-Store Return:

Visit any Decathlon store in Cyprus within 14 days from the date of product delivery. Ensure you bring the order printed receipt for a smooth return or exchange process.

• ACS Pickup Point

Visit your local ACS Pickup point within 14 days from the date of the product delivery. Ensure you bring the order printed receipt with a filled out return form.

• Home Return (Collection):

Contact our User service team to arrange for a home return. This option allows you to return the product without leaving your home. Please make sure to have the order printed receipt with a filled out return form ready for collection. Please note that there will be a minimum charge of €3.40 for home returns.

After our store team checks the return, we will be pleased to refund the amount excluding the transportation charges to the payment card used for your order, or through a gift voucher if paid by a gift voucher. Please note that products must be in their original packaging. All technical products will be subject to a quality check at the time of return.

A product may be returned for a refund within 14 days (with the exception of underwear and men's and women's swimming suits). To be eligible for a refund, the product must be new, fit for resale, and have the labels attached. Additionally, all components of the returned product must be included. The store reserves the right to refuse any return that is considered non-compliant.

We aim to make the return or exchange process hassle-free, ensuring your satisfaction with every purchase.

 

FORCE MAJEURE

Decathlon will not be liable for failure to perform any of its obligations to you, in whole or in part, or for damage or losses that you may incur if such non-performance, damage, or losses result from a case of force majeure or a natural disaster. Examples of force majeure events include, but are not limited to, earthquakes, floods, fires, pandemics, strikes, acts of terrorism, wars, government actions, and any other unforeseen circumstances beyond the reasonable control of Decathlon.

 

EXCLUSIONS AND LIMITATIONS OF LIABILITY

To the extent permitted by applicable laws, all products purchased through the website are solely subject to the warranties, if any, offered by the manufacturers, distributors, and suppliers. Decathlon , to the extent allowed by applicable laws, makes no express or implied representations, warranties, covenants, or conditions. The only warranty provided is the one expressly stated on the website. Without limiting the generality of the foregoing provisions, Decathlon expressly disclaims liability for claims related to normal wear and tear, misuse, improper use of the product, modification of the product, incorrect product selection, or misappropriation. In case of proceedings under these terms and conditions of online sale, Decathlon’s liability will be limited to the purchase price paid for the order by you to Decathlon.com.cy.

 

ENTIRE CONTRACT

In the event that any clause or clauses in these terms and conditions are declared invalid or void pursuant to any law, regulation, or decision of a court or administrative authority, the remaining clauses will continue to be valid and in effect.

Decathlon will exert its best efforts to replace any such invalid clauses with a valid clause that best aligns with the spirit of these terms and conditions. If a party chooses not to enforce any clause, whether permanently or temporarily, such forbearance may not, in any case, be considered a waiver of the clause.

 

JURISDICTION AND APPLICABLE LAW

These terms and conditions are governed by the laws applicable in Cyprus, and GDPR and any disputes arising from or related to them shall be under the jurisdiction of the competent courts in Cyprus.
